TERMS AND CONDITIONS OF USE

OCCIDENTAL TRAVEL www.occidentaltravel.com is a B2B tourism services sales platform that allows users to quote and purchase tourism services that may then be resold to their clients in accordance with the established terms of use.

Registration

Users must have their own OCCIDENTAL TRAVEL account, which will be created in accordance with client validation policies (Travel Agencies). Users shall be responsible for maintaining the confidentiality of their account and password. Users also acknowledge and agree that they are responsible for all activities, including purchases, carried out under their username or password.

The platform must be used only for individual reservations, meaning up to five (5) bookings for the same property on the same date. OCCIDENTAL TRAVEL leaves it to the discretion of the contracted service provider whether to accept reservations exceeding this limit and does not recommend that this limit be exceeded. Commission margins assigned to agencies are established in their contractual arrangements with OCCIDENTAL TRAVEL, and the rates shown are commissionable at the percentage established for each type of service.

Electronic Communications and Reservations

Users acknowledge and agree that all agreements, notices, disclosures, publications, and other communications sent to them electronically satisfy any legal requirement that such communications be in writing.

Users also agree that vouchers, settlement notices, notifications of upcoming cancellations, and effective cancellations will be automatically notified by email through our OCCIDENTAL TRAVEL platform.

Every reservation made shall be deemed accepted subject to the policy set forth in the Remarks paragraphs and the cancellation policy applicable to each reservation.

Any request for changes to a reservation must be submitted by email and shall be subject to the acceptance of the contracted service provider.

Payment Methods

The payment methods accepted by OCCIDENTAL TRAVEL are as follows: cash, bank transfers in DOP or USD, in-person card payments, payment links, and payment button transactions through OCCIDENTAL TRAVEL.

To complete a purchase, users may use any credit card authorized for online purchases. Online payments will be processed by a platform responsible for carrying out online validation with the respective banks. Use of such cards shall be subject to these Terms and Conditions in relation to the user's issuing bank, and to the provisions set forth in the applicable account opening agreements and credit card use regulations. In the event of any conflict, the terms of the latter instrument shall prevail.

With respect to bank cards accepted by OCCIDENTAL TRAVEL, aspects related to such cards, including issuance date, expiration, credit limit, blocks, and PIN or security code, shall be governed by the respective usage agreement of each bank, and the corresponding financial intermediary entity shall be responsible for such information. Accordingly, OCCIDENTAL TRAVEL shall have no responsibility whatsoever for any of the foregoing matters.

In that regard, the financial intermediary institution that issued the corresponding bank card, as part of its business activity, shall be solely responsible for any attack or attempted fraud involving such bank cards, including phishing, carding, or marbing; consequently, OCCIDENTAL TRAVEL shall not be liable in that respect, as such matters fall outside its scope of control.

No-Show and Failure to Appear on the Scheduled Service Date

All purchases of services offered through the OCCIDENTAL TRAVEL platform, or acquired directly, shall be honored in accordance with the agreed specifications and dates. This means that the risk of failing to appear for such service and the responsibility for losing the service due to a no-show shall be transferred to the user.

Any claim arising from a failure to appear due to force majeure must be duly supported, including documents evidencing the force majeure event, and shall be subject to the discretion of the contracted service provider as to whether the force majeure event qualifies for a change of date or cancellation without charge.

Intellectual and Industrial Property

All content included in or made available through OCCIDENTAL TRAVEL, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of OCCIDENTAL TRAVEL or its content suppliers and is protected by the copyright laws of the Dominican Republic and international laws. The compilation of all content included in or made available through any OCCIDENTAL TRAVEL service is the exclusive property of OCCIDENTAL TRAVEL and is protected by the copyright laws of the Dominican Republic and international laws.

Furthermore, the graphics, logos, page headers, button icons, scripts, and service names included in or made available through OCCIDENTAL TRAVEL are trademarks or trade dress of OCCIDENTAL TRAVEL in the Dominican Republic. The trademarks, logos, trade names, and any other distinctive signs of OCCIDENTAL TRAVEL may not be used in connection with any product or service that is not OCCIDENTAL TRAVEL's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits OCCIDENTAL TRAVEL.

All other trademarks not owned by OCCIDENTAL TRAVEL that appear on OCCIDENTAL TRAVEL are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by OCCIDENTAL TRAVEL. In that regard, OCCIDENTAL TRAVEL's trademarks or those of third parties appearing on the platform may not be reproduced or used separately outside the places where they appear.

Customer Service

Users may use OCCIDENTAL TRAVEL Customer Service by calling (829) 265-1525 from Monday to Friday, from 8:00 A.M. to 6:00 P.M. It will not be available on Sundays or public holidays.

Through Customer Service and through the OCCIDENTAL TRAVEL platform, users may inquire about the status of their reservation, payment due dates, current policies, or any other concerns. Governing Law and Forum

These Terms of Use are governed by the laws of the Dominican Republic. In the event that any conflict or discrepancy arises regarding their interpretation or application, the competent courts or administrative institutions of the Dominican Republic shall hear such conflict or discrepancy.

OCCIDENTAL TRAVEL shall pursue any breach of these Terms of Use, as well as any improper use of its platform and any infringement of the rights belonging to OCCIDENTAL TRAVEL or its licensors, especially intellectual and industrial property rights, by exercising all civil and criminal actions available to it under the law.

Privacy

OCCIDENTAL TRAVEL is committed to respecting users' privacy and the protection and security of the personal data of those who access and use OCCIDENTAL TRAVEL, as well as that of the final consumer of the product. Therefore, by means of this document, users are informed of the manner in which their personal information will be collected, processed, and protected, both the information provided directly to OCCIDENTAL TRAVEL and that derived from browsing, use, and enjoyment of the Services associated with OCCIDENTAL TRAVEL.

By using OCCIDENTAL TRAVEL, users freely, knowingly, specifically, and unequivocally consent to the practices described in this Privacy Policy. The collection of users' personal information by OCCIDENTAL TRAVEL shall be carried out for the purpose of constantly providing and improving OCCIDENTAL TRAVEL's products and services, and to provide as personalized an experience as possible.

Users may access their information, including name, address, payment options, profile information, and purchase history on the portal. OCCIDENTAL TRAVEL complies with all principles under applicable regulations, according to which personal data:

  • Shall only be processed lawfully and transparently (Principle of Lawfulness of Personal Data Files).
  • Shall be adequate, relevant, and not excessive. They shall be stored in a manner that allows the data subject to exercise the right of access. They must be accurate and kept up to date at all times (Principle of Data Quality).
  • Shall be collected for a specific, explicit, and legitimate purpose and shall not be kept longer than necessary.
  • Only the data necessary for each specific purpose shall be processed, taking into account the amount of data collected, the scope of processing, the retention period, and accessibility (Principle of Data Purpose).
What is the user's personal information used for?

OCCIDENTAL TRAVEL shall use users' personal information to operate, provide, develop, and improve the products and services it offers to its clients, such as:

  • Taking and managing reservations, processing payments, and communicating with users about reservations, services, and offers.
  • Communicating with users in relation to OCCIDENTAL TRAVEL through different channels, such as phone calls, email, or chat.
  • Preventing and detecting fraud and abuse in order to protect the security of its clients and OCCIDENTAL TRAVEL.
  • Data may also be used to prepare a commercial profile of the user that allows better fulfillment of the aforementioned purposes (such as better service and the sending of communications related to reservations).
  • Complying with legal obligations.

These are the types of personal information that OCCIDENTAL TRAVEL will retain: OCCIDENTAL TRAVEL shall only keep the data necessary for the operation of the commercial activity of travel agencies, such as name, ID or RNC, email address, telephone numbers, as well as the reservation history generated by the user.

With whom is the data shared?

OCCIDENTAL TRAVEL shall use users' personal information to operate, provide, develop, and improve the products and services it offers to its clients, such as:

  • External service providers. OCCIDENTAL TRAVEL will engage other companies and individuals to perform functions on its behalf, such as making reservations, relocating reservations, sending emails, removing duplicate information from customer lists, analyzing data, providing search results and links, processing payments, and transmitting content. These providers will have access to certain personal information necessary to perform their functions, but may not use it for other purposes.
  • Business transfers. As the business continues to develop, OCCIDENTAL TRAVEL may sell or buy other businesses or services. In such transactions, customer information is usually one of the transferred business assets. However, such information shall in all cases remain subject to the commitments undertaken in any pre-existing Privacy Notice (unless, of course, the customer authorizes otherwise). For greater clarity, any transfer of personal data shall be carried out taking into account the guidelines of Law No. 172-13 on Personal Data Protection in the Dominican Republic.
  • Protection of OCCIDENTAL TRAVEL. OCCIDENTAL TRAVEL will disclose account information and other personal information when it believes such disclosure is necessary to comply with the law; enforce or apply our Terms and Conditions; or protect the rights, property, or safety of OCCIDENTAL TRAVEL, its users, or others. This includes exchanging information with the corresponding financial institutions for fraud protection and credit risk reduction.
What responsibilities does the user have in relation to the data?

All users:

  • Shall guarantee that the data they provide to OCCIDENTAL TRAVEL is true, accurate, complete, and up to date. For such purposes, each user shall be responsible for the truthfulness of all data communicated and undertakes to keep the information provided duly updated so that it reflects the user's actual situation.
  • In the event they provide OCCIDENTAL TRAVEL with third-party data, they shall have informed such third parties of all aspects contained in this Privacy Policy, and shall either be legally authorized to communicate such data for the stated purposes or, where applicable, have obtained the authorization of the third party to do so.
  • Shall be responsible for any false or inaccurate information provided through OCCIDENTAL TRAVEL and for any direct or indirect damages caused thereby to OCCIDENTAL TRAVEL or third parties.
