Occidental Travel A.B., S.R.L. is a Dominican company operating as a tour operator and tourism service provider in the Dominican Republic. The company offers services that may include excursions, airport and private transfers, hotel reservations, travel packages, car rentals, and related tourism services.

For purposes of these Terms and Conditions, the expressions "Occidental Travel", "the company", "we", "us", or "our" refer to Occidental Travel A.B., S.R.L. The expressions "customer", "client", "traveler", "user", "you", or "your" refer to any person accessing the website, requesting a quotation, making a reservation, or purchasing a service.

2. Acceptance of Terms

By accessing this website, requesting information, making a reservation, or completing a payment, the customer acknowledges that they have read, understood, and accepted these Terms and Conditions. If the customer does not agree with these Terms and Conditions, the customer should not use the website or purchase services through Occidental Travel.

These Terms and Conditions apply to all bookings made through the website, by email, WhatsApp, telephone, social media, authorized sales representatives, or any other official communication channel used by Occidental Travel.

3. Nature of Services

Occidental Travel provides and coordinates tourism services. Depending on the specific service purchased, Occidental Travel may act as a direct provider, coordinator, reseller, intermediary, or booking agent for third-party operators, transportation providers, hotels, attractions, excursions, restaurants, guides, or other suppliers.

The company makes reasonable commercial efforts to provide accurate information and coordinate services professionally. However, certain parts of a tourism service may depend on third parties, weather conditions, road conditions, maritime conditions, public authority decisions, hotel policies, attraction availability, or operational circumstances beyond the direct control of Occidental Travel.

4. Website Use

The customer agrees to use the website only for lawful purposes and in accordance with these Terms and Conditions. The customer must not use the website for fraudulent, abusive, misleading, unauthorized, illegal, or harmful activities

The customer agrees not to interfere with the operation, security, availability, or integrity of the website, payment systems, booking forms, servers, databases, or communication channels of Occidental Travel.

5. Customer Information and Accuracy

The customer is responsible for providing accurate, complete, and updated information when requesting a quotation, making a reservation, or completing a payment. This may include full name, email address, telephone number, hotel or pickup location, room number when applicable, travel dates, number of passengers, special requests, flight details, and other relevant service information.

Occidental Travel is not responsible for service delays, failed pickup, incorrect confirmations, missed activities, or other issues caused by incorrect, incomplete, delayed, or misleading information provided by the customer.

6. Reservations and Availability

All reservations are subject to availability and confirmation. A payment, payment request, quotation, or booking request does not guarantee availability until Occidental Travel confirms the reservation through an official communication channel such as email, WhatsApp, or written confirmation.

Occidental Travel may request additional information before confirming a reservation. If the required information is not provided on time, the reservation may remain pending or may be canceled according to the applicable service policies.

7. Prices and Quotations

Prices published on the website or provided by Occidental Travel may vary depending on season, availability, number of passengers, pickup location, service category, supplier conditions, taxes, fuel costs, exchange rate variations, or other operational factors.

A quotation is valid only for the period expressly indicated in the quotation. If no validity period is stated, the quotation remains subject to confirmation at the time of payment and booking.

8. Payments

Services may require full payment or a deposit before confirmation, depending on the service type and booking conditions. Payment methods may include credit card, debit card, bank transfer, online payment gateway, or other methods approved by Occidental Travel.

The customer is responsible for ensuring that the payment method used is valid, authorized, and lawfully available for the transaction. Any bank fees, exchange rate differences, chargeback fees, rejected payment costs, or third-party payment charges may be the responsibility of the customer when applicable.

9. Customer Responsibilities During Services

The customer must follow all safety instructions, pickup instructions, schedules, itinerary conditions, age restrictions, physical requirements, and operational rules communicated by Occidental Travel, the supplier, guide, driver, attraction, hotel, or any authorized representative involved in the service.

The customer is responsible for personal belongings, travel documents, health conditions, mobility limitations, allergies, special needs, and any personal circumstances that may affect participation in a service. The customer must notify Occidental Travel in advance of any condition that may require special coordination

10. Conduct and Right to Refuse Service

Occidental Travel and its suppliers reserve the right to refuse, suspend, or terminate a service when a customer engages in unsafe, aggressive, abusive, intoxicated, illegal, discriminatory, disrespectful, or disruptive behavior, or when the customer fails to comply with safety instructions or operational rules.

In such cases, the customer may lose the right to participate in the service and may not be entitled to a refund.

11. Changes to Itineraries

Tourism services may be affected by weather, traffic, road conditions, sea conditions, supplier availability, public authority restrictions, operational matters, safety concerns, or force majeure events. Occidental Travel reserves the right to adjust pickup times, routes, order of activities, vehicles, boats, attractions, or itinerary details when necessary for safety, logistics, or service execution.

Reasonable itinerary changes do not automatically entitle the customer to compensation or refund when the essential nature of the purchased service is provided.

12. Third-Party Suppliers

Some services may be operated by third-party suppliers. Occidental Travel works with suppliers in good faith and aims to coordinate reliable services; however, Occidental Travel is not liable for the independent acts, omissions, negligence, policies, delays, cancellations, accidents, or failures of third-party suppliers beyond the control of Occidental Travel, except where applicable law provides otherwise.

13. Travel Documents and Legal Requirements

The customer is responsible for having valid identification, passports, visas, permits, tickets, hotel access authorization, driver licenses, or any other document required for the service, activity, transportation, or travel arrangement. 14. Health, Safety, and Risk Acknowledgment

Tourism activities may involve inherent risks, including transportation risks, maritime risks, weather exposure, walking, swimming, boating, adventure activities, animals, natural environments, or public spaces. By booking a service, the customer acknowledges these risks and agrees to act responsibly and follow instructions.

Customers with medical conditions, pregnancy, disabilities, mobility limitations, allergies, or other special circumstances must inform Occidental Travel before booking so the company can verify suitability when possible. Participation may be restricted for safety reasons.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Occidental Travel shall not be liable for indirect, incidental, consequential, special, punitive, or loss-of-opportunity damages arising from the use of the website, booking process, service changes, delays, supplier actions, force majeure events, customer conduct, or circumstances outside the company control.

Nothing in these Terms and Conditions excludes liability where such exclusion is not permitted by applicable law

16. Force Majeure

Occidental Travel shall not be responsible for failure or delay in performance caused by events beyond reasonable control, including but not limited to weather events, hurricanes, storms, floods, earthquakes, pandemics, strikes, civil disturbances, government restrictions, transportation disruptions, road closures, supplier failures, accidents, maritime restrictions, power failures, or other events of force majeure.

17. Intellectual Property

All website content, including logos, trade names, text, images, designs, graphics, tour descriptions, service descriptions, documents, and marketing materials, is owned by or licensed to Occidental Travel unless otherwise stated. The customer may not copy, reproduce, modify, distribute, or use such content for commercial purposes without prior written authorization.

18. Privacy and Data

The handling of customer personal information is governed by the Privacy Policy and related Service Policies of Occidental Travel. By using the website or purchasing services, the customer accepts that personal information may be processed for booking management, customer service, payment verification, service coordination, and legal or operational purposes.

19. Complaints and Customer Support

Any complaint or service concern should be reported as soon as possible through official contact channels. The customer should provide booking details, receipt number, service date, customer name, and a clear description of the issue so Occidental Travel can review the matter properly.

Occidental Travel will make reasonable efforts to respond to customer concerns in a professional and timely manner.

20. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Dominican Republic. Any dispute arising from the use of the website, booking process, payment, or services shall be subject to the competent courts of the Dominican Republic, unless mandatory consumer protection rules establish otherwise.

21. Updates to These Terms

Occidental Travel may update or modify these Terms and Conditions at any time. The version published on the website at the time of the booking or transaction shall apply, unless a mandatory legal requirement provides otherwise.
